Please read these Terms of Use (“Terms”) carefully before using The Allergic Dog™ website (the “Site”) or any products, content, information and services offered by The Allergic Dog LLC, a Massachusetts limited liability company doing business as The Allergic Dog™ (collectively, the "Services") ("Company," "we," "us," or "our"). These Terms apply to all visitors, users, and subscribers of the Site and any associated Services, platforms, tools, or subscription products, including AxiDerm™. By accessing or using the Site or the Services, and/or by clicking “I agree,” “Accept,” “Create Account,” or a similar affirmative assent mechanism at account creation, checkout, or first login, you agree to be bound by these Terms. These Terms incorporate by reference our Medical Disclaimer and our Privacy Policy, each available on the Site. If you enter into the Terms on behalf of an entity, you represent that you have authority to bind that entity to the Terms. If you do not agree, please discontinue use immediately.

1. About This Website and Our Services

The Allergic Dog™ is a veterinary education and clinical tools platform offering educational content, courses, resources, and clinical decision-support tools for veterinary professionals, dog owners, and pet groomers. Our Services include, without limitation:

  • Free and paid educational content on theallergicdog.com, including blog posts, videos, and courses (“General Website Content”);
  • Online courses available for a one-time purchase price, such as Itch to Answer™ and Beyond Expression™ ("Paid Courses"), together with free educational courses and resources such as Ear Infection Essentials™;
  • AxiDerm™ — a browser-based clinical decision support platform available by annual subscription exclusively to licensed or credentialed veterinary professionals.

2. Audience and Eligibility

2.1 General Website Users

General Website Content is intended for a broad audience, including dog owners, pet groomers, and veterinary professionals. All users must be at least 18 years of age.

2.2 Course Subscribers

Paid Courses may be designated for specific audiences, including veterinary professionals, dog owners, or groomers. By enrolling in a Paid Course, you represent that you are the intended audience for that course as described at the point of purchase.

2.3 AxiDerm™ Subscribers

Access to AxiDerm™ is limited exclusively to licensed or credentialed veterinary professionals, including veterinarians, veterinary specialists, and veterinary technicians working under the supervision of a licensed veterinarian. By subscribing to AxiDerm™, you represent and warrant that:

  • You are a licensed or credentialed veterinary professional in good standing in your jurisdiction;
  • You are accessing AxiDerm in your professional capacity;
  • You are not a lay person seeking to access AxiDerm™ for personal use.

We reserve the right to terminate access for any user who does not meet these eligibility requirements. You acknowledge that, as part of account creation or access to AxiDerm™, you may be required to affirmatively confirm your licensure status via a checkbox or similar mechanism. We reserve the right (but have no obligation) to verify your credentials and to suspend or terminate access if such information is inaccurate.

3. Medical and Clinical Disclaimer

3.1 General Website Content

General Website Content provided on the Site is for informational and educational purposes only. It is not intended to constitute veterinary advice, diagnosis, or treatment. Always consult a licensed veterinarian before making any changes to your dog’s medical or healthcare routine.

3.2 No Veterinary-Client-Patient Relationship

Use of the Site or any of our Services does not create a veterinary-client-patient relationship between you and The Allergic Dog™ or Dr. Meagan Painter, DVM, DACVD. All content provided on the Site or through the Services is educational in nature and is not tailored to any specific patient or clinical situation.

3.3 AxiDerm™ — Clinical Decision Support

The tools, calculators, decision trees, scoring systems, and all content available through AxiDerm™ are provided for educational and clinical decision-support purposes only. They are intended to assist licensed veterinary professionals in their clinical reasoning and are not a substitute for professional veterinary judgment, examination, diagnosis, or treatment.

The Company makes no representations or warranties that AxiDerm™ outputs are accurate, complete, current, or appropriate for any specific patient or clinical situation. You assume full responsibility for all clinical decisions made in connection with your use of AxiDerm™. The Company shall not be liable for any patient outcomes, adverse events, or professional consequences arising from reliance on AxiDerm™.

This Section 3 is supplemented by, and should be read together with, our Medical Disclaimer, which is incorporated by reference into these Terms.

The Clinical Use Acknowledgment presented at account creation is attached as Exhibit A and incorporated into these Terms. In the event of any conflict between Exhibit A and this Section 3, this Section 3 controls.

4. Subscription, Payment, and Refund Policy

4.1 Course Purchases

Paid Course purchases are one-time payments that grant you lifetime access to that course content as it exists at the time of purchase, subject to these Terms and for as long as the Company continues to offer the course. Paid Courses may be updated over time; updates will be provided at no additional charge unless otherwise stated.

Important note on continuing education credit. Certain Paid Courses may be approved for continuing education credit by the American Association of Veterinary State Boards' RACE program or another accrediting body at the time of purchase. Continuing education approval is granted for a limited period and is subject to renewal at the Company's discretion. The Company does not guarantee that any Paid Course will remain approved for continuing education credit for the duration of your access, and no refund or credit will be issued if approval lapses or is not renewed. You are responsible for confirming that a course is currently approved, and that your licensing board accepts the credit, before relying on it to satisfy any continuing education requirement.

4.2 AxiDerm™ Subscription and Free Trial

Access to AxiDerm™ is available on an annual subscription basis. Pricing tiers include a founding member rate and a standard rate, as published on the Site at the time of enrollment. Your applicable rate will be displayed and confirmed at checkout before you provide payment information. Founding member pricing applies for as long as your subscription remains continuously active and is forfeited if your subscription lapses or is cancelled.

New AxiDerm™ subscribers may be offered a free trial of fourteen (14) days beginning on the date you create your account and provide a valid payment method. A valid payment method is required to begin the trial. You will not be charged during the trial period. You may cancel at any time before the trial ends through your account settings or by emailing info@theallergicdog.com, and you will not be charged. If you do not cancel before the trial ends, your subscription will automatically convert to a paid annual subscription and your payment method will be charged the annual rate displayed at checkout on the first day after the trial ends. The date and amount of that first charge will be shown to you at checkout and in a confirmation email when your trial begins. Once the first charge has been made, Section 4.4 applies and no refund will be issued. Free trials are limited to one per person, and we reserve the right to decline or end a trial for any user we reasonably believe has previously used a trial or is otherwise ineligible.

Each AxiDerm™ subscription is licensed to one individual veterinary professional for that individual's own professional use. Your subscription may not be shared with, or used by, other veterinarians, technicians, or staff at your practice, whether by sharing login credentials, using a shared device or account, or otherwise. Practices, hospitals, and groups that wish to provide AxiDerm™ access to multiple team members should contact us at info@theallergicdog.com to arrange group pricing. We reserve the right to suspend or terminate any subscription that we reasonably believe is being used by more than one person, without refund, and to require the practice to enter into a group subscription as a condition of restored access.

4.3 Auto-Renewal

AxiDerm™ subscriptions automatically renew for successive annual terms at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method on file for each renewal term. Renewals will be charged at your then-applicable rate; if the rate for your subscription will change at renewal, we will notify you by email at least thirty (30) days before the renewal date. We will also send a reminder to the email address on your account at least thirty (30) days before each annual renewal, including the renewal date, the amount to be charged, and instructions for cancelling.

4.4 No Refunds After Access

All fees — including Paid Course purchases and AxiDerm™ subscriptions — are non-refundable once access has been granted. This policy applies: (a) once you are granted access to the Paid Course or other content, whether or not you access or use it; and (b) to all partial billing periods and unused portions of any subscription or course term.

4.5 Cancellation

You may cancel your AxiDerm™ subscription or trial at any time through your account settings or by emailing info@theallergicdog.com. Cancellation of a trial takes effect immediately and no charge will be made. Cancellation of a paid subscription takes effect at the end of your current annual billing period; you will retain access through the end of the paid term, and no prorated refund will be issued for the remaining period. Cancelling through account settings is intended to be as simple as the process by which you subscribed. If you cancel by email, we will confirm your cancellation in writing.

4.6 Payment Processing

Payments may be processed by third-party providers. By providing payment information, you authorize such providers to charge your payment method in accordance with these Terms and their applicable terms.

5. Intellectual Property

All content, information, tools, frameworks, methodologies, brand names, course materials, videos, graphics, logos, and blog posts available on or through the Site and the Services are the proprietary intellectual property of the Company and are protected by applicable copyright, trademark, and other intellectual property laws. This includes, without limitation:

  • The Allergic Dog™
  • AxiDerm™ 
  • Itch to Answer™
  • Ear Infection Essentials™
  • Beyond Expression™
  • Proven Protocols™
  • Medication Masters™
  • Inflammation First® 

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our content and Services solely for their intended purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, transmit, resell, or otherwise exploit any content or Services without our prior written consent. You may not use our content or Services to develop, train, or improve any competing product or service, including any clinical decision-support tools, whether commercial or non-commercial.

6. Acceptable Use

By using the Site and the Services, you agree that you will not:

  • Share login credentials or allow others to access the Site or the Services using your account, including sharing an AxiDerm™ subscription with colleagues or staff at your practice;
  • Resell, sublicense, or transfer access to the Site or any Services to any third party;
  • Scrape, copy, reverse engineer, decompile, or disassemble any portion of the Site or the Services;
  • Use the Site or the Services for any unlawful purpose or in violation of any applicable laws or regulations;
  • Reproduce or redistribute the Site or the Services, including without limitation any course materials, videos, or clinical tools in any form;
  • Use the Site or the Services in any manner that could damage, disable, or impair their operation;
  • Use AxiDerm™ for any purpose other than your own professional use as a licensed or credentialed veterinary professional;
  • Input or upload to the Site or the Services any data that you do not have the legal right to use, including personal information of clients or other individuals that you are not authorized to share;
  • Use automated systems (including bots or scraping tools) to access the Site or the Services.

7. Data and Security

We implement commercially reasonable measures designed to protect the security of the Site, the Services, and user data. However, no system can be guaranteed to be completely secure, and we do not warrant that our services will be free from unauthorized access, interruption, or data loss. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized access or suspected security incident. You acknowledge that you use the Services at your own risk with respect to data security and transmission of information over the internet.

8. User Content

If you submit testimonials, reviews, comments, or other content to us or through our platforms, you grant the Company a non-exclusive, royalty-free, perpetual license to use, reproduce, display, and distribute that content across our marketing platforms and materials. You represent that you own or have the right to submit such content, and you grant us the right to use your name, likeness, and professional credentials in connection with such content, unless you request otherwise in writing.

9. Account Termination

9.1 Termination by You

You may cancel your subscription or discontinue use of our services at any time in accordance with Section 4.5.

9.2 Termination by Us

We reserve the right to suspend or terminate your access to the Site, and any or all of our Services, at any time, with or without notice, for any of the following reasons:

  • Your violation of these Terms or any applicable laws;
  • Your failure to meet applicable eligibility requirements;
  • Your non-payment of subscription or course fees;
  • Any conduct by you that we determine, in our sole discretion, is harmful to the Company, other users, or the integrity of our platforms.

We shall have no liability to you for any suspension or termination of access to the Site or the Services in accordance with these Terms. Sections 3, 5, 7, 8, 10, 11, 12, 13, and 16 of these Terms will survive any termination.

10. No Guarantees

We provide tools, education, and clinical resources — but outcomes vary based on individual patient health status, owner and veterinary team compliance, environmental factors, and consistency of implementation. We make no guarantees regarding specific outcomes from use of the Services, including without limitation any of our content, courses, or tools. Please use the Services responsibly and in conjunction with appropriate veterinary guidance.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR THE SERVICES, INCLUDING WITHOUT LIMITATION OUR COURSES OR PLATFORMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE COMPANY’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

THE SITE AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, THE COMPANY SHALL HAVE NO LIABILITY FOR ANY CLINICAL DECISIONS, PATIENT OUTCOMES, OR PROFESSIONAL ACTIONS TAKEN IN RELIANCE ON AXIDERM™ OR ANY CONTENT PROVIDED THROUGH AXIDERM™ OR THE SERVICES.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company, Dr. Meagan Painter, DVM, DACVD, and their respective affiliates, members, managers, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site or the Services, your violation of these Terms, or your violation of any rights of another party, including, without limitation, any claims arising from your provision of veterinary services, clinical decisions, or use of AxiDerm™ in a professional capacity.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts, and you hereby consent to personal jurisdiction in such courts.

14. Third Party Add-Ons and Links

Third party websites, plugins, modules, themes, and other add-ons (collectively, “Third Party Add-Ons”) may be available via the Site or the Services. Third Party Add-Ons are subject to, and governed by, their respective license terms, and those terms will prevail over these Terms of Use as to your use of the Third Party Add-Ons.

The Site and the Services may also contain links to third-party websites or resources, including without limitation links to Third Party Add-Ons. These links are provided solely as a convenience to you. You acknowledge and agree that we are not responsible or liable for: (a) the availability or accuracy of such websites or resources; or (b) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by us of such websites or resources or the content, products, or services available from such websites or resources. Nor do links to such websites and resources imply that we are affiliated or associated with the linked third-party site. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

15. Updates to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify subscribers by email. For material changes affecting AxiDerm™ subscribers, we may also require you to affirmatively accept the updated Terms at your next login before continuing to use AxiDerm™. Your continued use of the Site or the Services after the effective date of any updated Terms constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.

16. General Terms

If any provision contained in these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions set forth herein, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

Before you start:

  • AxiDerm™ does not replace your exam, your diagnostics, or your judgment. You make the clinical decisions and you are responsible for them. Tool outputs are not diagnoses.
  • Using AxiDerm™ does not create a veterinary-client-patient relationship.
  • Drug labels, doses, and guidelines change. Check current labeling and the rules in your jurisdiction before you act.
  • This subscription is licensed to you as an individual. Do not share it with colleagues or staff. Practice and group rates are available.
